1. About us

This website www.ihouse.at (hereinafter "the website") is the property of Vincent Harry Gruen (hereinafter "iHouse" or "we"), having its head office at Laurenzgasse 13, 1050 Vienna, Austria, is registered at the magistrate Vienna and is member of the WKO Vienna. We have the right to make changes or additions to this policy at any time and will provide the information as an updated version of the General Terms and Conditions (hereinafter “GTC”) on the website. For any kind of information regarding these terms in general, or any changes undertaken, you can always contact us via office@ihouse.at. The privacy of our users is important to us and we take care to safeguard it. This policy explains why and how we collect and use the personal data of our customers and is effective from 1 January 2013.

a) Communication

When you visit www.ihouse.at or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. We refer to the customer as “she” but of course both genders are directed. Furthermore, our operating and contractual language is English.

b) OeAD-Housing Office

iHouse has a strong cooperation with the OeAD-Housing Office but we have to state, that iHouse is an own-standing company and has no legally binding connection to OeAD-Housing Office.

2. The customer

To be a Customer of the website you must be a consumer, of legal age and with full legal capacity or to be authorized by your parents to order on the website. The personal information you give to iHouse when booking our service must be complete, accurate and up to date. iHouse is not responsible for non-performed services should the data prove incorrect. iHouse reserves the right to cancel any order should the IP address of the customer be located in a country different from the billing address.

3. The service

iHouse supports international students arriving in Vienna. Our Student Welcome Service (hereinafter "the SWS") can include a Welcome at the Vienna International Airport (hereinafter “VIA”) or at the security company Hel-Wacht (hereinafter “Helwacht”), transportation to the customer’s OeAD guesthouse, as well as Key Support, Survival Guide and Personal Assistant (hereinafter “PA”).

In the following, a detailed description of the different features:

a) Airport Pickup

When you leave the baggage claim at the Vienna International Airport at the time you have indicated in the Ordering Process (4) you will be handed over to a professional airport-pickup company, that provides the ride to the Student dormitory, as well indicated in the Ordering Process (4). Delay policy - Using the flight number, we can track any changes in the arrival time and will adequately adjust performance of our services. However, if the flight is missed we cannot guarantee any transportation through iHouse. Should any circumstances other than the ones defined above delay the arrival, we accept a waiting period of up to 60 minutes, starting as of the scheduled arrival time, at the arranged meeting point. Customers arriving later will have to organize transportation to their dorm on their own and also bear all extra costs accruing in that context. Nevertheless, the contract will still remain valid and the customer will receive the Keys and the Survival Guide once she has contacted us at office@ihouse.at.

b) Key Support

As an official partner of the OeAD-Housing Office, iHouse collects the keys of its customer in advance from the OeAD-Housing Office or its affiliated partners. This ensures that keys can be handed over to you directly at the VIA or at Helwacht, before being taken to the student dormitory. You are required to show the iHouse student either your confirmation of order or an official Identification Card (Passport) in order to verify identities. The receipt of keys has to be confirmed by you signing a document or a copy of your passport to that effect.

c) Survival Guide

Our “Survival Guide”, which customers receive, includes helpful information that have turned out to be useful for international students during their first days in Vienna.

d) Personal Assistant

The Personal Assistant (hereinafter “PA”) is the customers contact person before arrival and for the first steps in Vienna. He or she supports and assists the customer with administrative procedures, concerning Housing Office Registration, University Registration, Municipal Office Registration, filling out the housing inventory list, organizing the ticket for public transportation, accompanying the customer to collect the residence permit (Visa) if needed, guiding the customer through the health insurance process and finding the right bank account and phone plan. The PA has a Checklist with the 10 tasks he or she is obligated to fulfill with the customer. After fulfilling these tasks, the PA and the customer have to sign the Checklist and from this moment on the service is completed.

4. The ordering process

The acceptance of orders placed on the Website is subject to compliance with the procedure set up by iHouse. This takes the form of a series of succeeding screen pages indicating the steps to be taken by customers to validate their order. Prior to placing their order, customers have to verify all order details, as well as the total price online, and make changes, if need be. Every order confirmed by iHouse constitutes as a sales contract on the same terms. One booking counts for only one arrival of a single person. iHouse reserves the right to refuse acceptance of an order placed by a customer with whom a dispute is pending in connection with the payment of a former order as well as an order that is not mirror the provisions of these general terms of sale. In any such cases, iHouse will inform the customer by e-mail. Unless the customer contacts us to correct the error or the non-compliance with these general terms of sale, we reserve the right not to process the order. Once the customer has placed her order after reviewing all order details online, iHouse will promptly confirm her order by e-mail to the address provided to us. In that aim, the customer formally accepts the use of e-mail by iHouse to confirm the content of the order. Our confirmation e-mail will include all information provided by the customer, as well as the accepted price and terms of payment with an indication, as the case may be, of any possible difficulties or reservations in respect of the order.

a) Acceptance of the GTC & collecting of keys

The contract will only come into force if it fully reflects our General Terms & Conditions as confirmed by you by checking boxes on our website. Once you have checked the relevant box, iHouse is authorized to collect your keys from the OeAD-Housing Office in advance.

b) Following notification

Once you have successfully validated your order, an automated invoice containing the booking and order confirmation will be returned. If you choose to pay by bank transfer you will receive a further e-Mail with the payment confirmation, after your payment is effected. Furthermore you will receive an e-mail that explains, where you stand right now in the process and that gives a good overview over the next steps to be done. This includes the arranged meeting point at the airport or the exact address to pick up you key in the center of Vienna, as well as information on how you can easily change the date of arrival if necessary.

c) Subsequent change of information

Subsequent changes, if any, to information you provided, as for instance on flight data or the dormitory, must be communicated via email (office@ihouse.at). In order to be accepted on our part, such changes must be made no later than 7 days prior to the arrival date; iHouse will rely on the accuracy of your information last communicated. Should the arrival time last communicated to us turn out to be incorrect, iHouse assumes no liability for the non-performance of our service at your actual arrival time.

5. The use of information

iHouse collects personal data on the Web site that is required for processing orders. Such data may be communicated, in whole or in part, to our service providers involved in fulfilling the order. You are informed that bodies in charge of analyzing orders and fighting against credit card fraud also collect such personal data. You have a right to access, modify, correct, oppose and delete personal data concerning you. You may be asked to provide your name, e-mail address or other personal information on various pages on our site in order that your enquiry can be dealt with. When you provide this information you are asked whether you wish to receive any further communication from iHouse. If you choose not to receive further communications we will only use your name and address details to respond to your enquiry. We will not use it for any other purpose and it is never sold to any third party. We may use mailing houses to process certain mailings and external research agencies to carry our market research on the iHouse behalf. We ensure that such agencies will also handle information securely. We will use any demographic information you provide for market research purposes (in aggregate form) only. These statistics will not include any information that could be used to identify any individual. Affiliated iHouse Services on other sites - We offer some of our services on or through other web sites. Personal information that you provide to those sites may be sent to iHouse in order to deliver the service. We process such information under this Privacy Policy. The affiliated sites through which our services are offered may have different privacy practices and we encourage you to read their privacy policies. We don’t save your credit card information and we do not store personal information on our servers unless required for the on-going operation of one of our services.

a) Information Security

Credit Card Transactions - This site uses industry standard Secure Sockets Layer (SSL) servers on our transaction pages. It encrypts all of your personal information including name, address, and credit card number to prevent unauthorized access as the information travels over the Internet. We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data. We restrict access to personal information to iHouse employees, contractors and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

b) Cookies

When you visit www.ihouse.at, we may use cookies to store your preferences to enable us to deliver customized web page content through uniquely identifying your browser. Cookies are small text files that are transferred to your computer's hard drive through your web browser when you visit websites. A cookie contains a unique number, but no personal data. We will not use the cookie to identify you personally. We use cookies to improve the quality of our service, including for storing user preferences, improving search results and ad selection, and tracking user trends, such as how people search. Most browsers allow you choose whether cookies are used or not. Links are provided for your convenience only and iHouse is not responsible for the content or privacy practices of any other website linked to or from the iHouse website. Use of any such links will not render iHouse liable to you or any other person for loss or liability of any kind. We have tried to ensure that links to off-site materials are clearly indicated. If we have linked to your material and not clearly indicated that the content is non- iHouse, please let us know via office@ihouse.at so that we can resolve the matter by making the link clearer. iHouse provides links to other organizations through this website. These links are provided for additional information as a service to our customers. In providing these links, iHouse does not endorse the content, products, services or viewpoints expressed by these external sites. Once you leave iHouse website and link to an external site, the iHouse Internet policies no longer apply and you will be subject to the new site's policies. Links from others sites - Links may be made to the iHouse website without requiring specific permission. d) Restrictions

All informations about iHouse partner companies at our homepage are provided by the particular partner and remain their intellectual property. The owner of this website does not assume any liability for products or services recommended here and/or provided on websites linked to. This site iHouse is owned and operated by Vincent Harry Gruen. No material from www.ihouse.at or any website owned, operated, licensed, or controlled by Vincent Harry Gruen may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except that you may download one copy of the materials on any single computer for your personal, non-commercial home-use only, provided you keep all copyright and other proprietary notices intact. Modification of the material or uses of the materials for any other purpose is a violation of iHouse copyright (5.4) and other proprietary rights. For purposes of these terms, the use of any such material on any other website or networked computer environment is prohibited.

e) Copyright

All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of iHouse or its content suppliers and protected by Austrian and international copyright laws. The compilation of all content on this site is the exclusive property of iHouse and protected by Austrian and international copyright laws. All software used on this site is the property of iHouse or its software suppliers and protected by Austrian and international copyright laws.

f) Opt-out (newsletter)

The site provides you with the opportunity to choose to receive email communications about this site and the groups you are registered with, as well as emails from other members. In all email communications that you receive from this community, except for confirmation emails for service registrations or other payments, you will be provided an unsubscribe option where you can opt out of the particular type of email communication.

g) Accuracy of information

Every reasonable effort has been made to ensure the accuracy of the information published on this website. However, the information on this website is regularly reviewed and is subject to change from time to time. If you believe that any information iHouse has published on the website is incorrect, you should e-mail office@ihouse.at - any information which is found to be incorrect will be corrected as soon as possible. Nevertheless, iHouse does not accept responsibility for any losses caused by errors or inaccuracies in the information within the website.

6. The contract

The following General Terms & Conditions describe the contractual relationship between iHouse and the customer regarding the use of the service “Student Welcome Service” (hereinafter “SWS”). The services provided by iHouse are explicitly based on these General Terms & Conditions.

a) Price

All prices indicated on our website are in euro and with Value Added Tax (VAT) included. Thus, the total order price shown in the cart, includes all fees. iHouse reserves the right to modify prices from time to time. Invoiced prices, however, are not subject to change. Processing your payment via credit card or Paypal you have the possibility to display the price in US-Dollars.

b) Terms of payment

To pay your order, you may use: Paypal, transaction or credit card. You have access to a dedicated space made available by a banking establishment, which ensures the security and recording of the payment order. To this effect, you expressively authorized iHouse to debit your account accordingly to the amount of the ordered services. Data registered and saved by iHouse act as a proof of order and of all transactions done. Data registered by the payment system act as a proof of the financial transactions. Your credit card has to be valid and have sufficient funds available. For the transfer of money via Paypal, you have to agree to the General Terms & Conditions of Paypal. In order to verify you as the official cardholder, the partner companies may ask for prove of identity at any time. If the identity cannot be verified the partner company may refuse giving the offer stated on www.ihouse.at. Payment must be effected at the latest 7 days before the date of arrival, in order to perform the service. Otherwise the contract will not be valid anymore, unless differently arranged between you and iHouse.

c) Liability

iHouse can solely be held liable for non-performance of Service (III). However, the customer has a right of refund (VI.5.) if iHouse does not provide the right keys, appropriate transportation to the student dormitory or the Survival Guide. iHouse does not assume any liability for damage as a result of: taxi-transportation - Once the customer has been handed over to the airport pickup company, liability passes from iHouse to the airport pickup company. Loss or damage of keys - Once the keys have been handed over to the customer, liability for the keys is with the customer only. Accuracy of the Survival Guide – Every reasonable effort has been made to ensure the accuracy of the information provided in the Survival Guide. However, iHouse does not accept responsibility for any loss or damage caused by errors or inaccuracies in the information provided in the Survival Guide. Personal Assistant – The PA and iHouse cannot be held liable for anything except not performing (3). The PA only assists, supports, accompanies, recommends and has no influence on the registration offices, or anything else concerning companies that are not iHouse.

d) Right of cancellation

You have the right of cancellation, without having to indicate the reasons for such cancellation, within a cooling-off period of 7 working days from the ordering date. You are responsible for appropriately communicating your cancellation. Notification of order cancellation is by email only. We reserve the right to levy a € 30.00 charge to cover any subsequent administrative expenses. No refunds shall be offered where provision of a service is deemed to have begun and is, for all intents and purposes, under way, as during the period of 7 working days before the indicated arrival date.

e) Policy of refund

The amount paid to us, reduced by the fee of €30.00 to cover subsequent administrative expenses, if any, will be refunded by iHouse as this constitutes payment for unused Services. iHouse will refund amounts for unused services no later than 30 days following the date of cancellation the same way payment has been received from you.

f) Court of jurisdiction

Every order is submitted to your acceptance of the General Terms & Conditions of use, which are subject to the Austrian law. In case of litigation, the Austrian Courts shall have the exclusive jurisdiction to resolve it. In case of problem or complaint, you may address to office@ihouse.at to find a mutual agreement. The agreement shall be governed by and construed in accordance with Austrian law. Place of performance is Klagenfurt, Austria. The courts of Klagenfurt, Austria shall have exclusive jurisdiction.
